Park
Carmella turns up in her best togs to dig up the buried cash but finds nothing there but a big hole in the ground.
Number 30
Rosie sits looking at the briefcase of cash. She hears Frazer coming in and quickly hides it away, instead concentrating on her legal work. He asks if she's okay and mentions Carmella's determination on the matter of visiting Rocco. Rosie muses that quiet reflection isn't Carmella's thing. Fraze wonders if Rosie's being hassled into going but she tells him no one can pressure her into it. Frazer knows that and tries to show her the time, only for Rosie to get all flustered when she realises it's 7.30.
FRAZER: Hi, I'm Frazer Yates, boyfriend of Rosetta Cammeniti. My interests include listening sympathetically, giving shoulder rubs -
Rosie ends up yelling at him - if she's not on top of things for Max's sentencing Toadie will have a field day! Frazer says nothing and Rosie tells him he's a sweet boy but she's okay. Frazer leaves her to it.
Number 32
Toadie talks over the trial with Max and Steph. He tells them that the prosecutor's job is to get maximum jail time - therefore he'll keep things bleak and simple. Cam lost his life due to Max and there's no refuting the fact Max's actions led to his death...
Steph flinches, not wanting to hear it all again, but Max tells Toadie to go on.
Toadie will make things personal - more complicated and emotional. He'll show everyone how much Max has suffered.
Max's phone rings - it's Summer and he goes out the back to take the call.
Steph tells Toadie that he doesn't have to do this - last week he didn't even want to be her friend. Toad informs her that he's billing her for his time (far from a friendly gesture). Steph doesn't doubt he'll do a good job but it might be easier if Max got another lawyer. Toadie makes it obvious it's daft to think he could get another one in time for the hearing tomorrow. Anyways this is going to be great for Toadie's career - with such a high-profile case he'll get his mug on TV and be up there with the big boys! Steph stares coldly at him.
Boyd's eavesdropping in the hallway and asks Janae if she can believe Stax are letting Toadie defend Max. Janae reminds him that Toad is a good lawyer. Boyd thinks he wants Max in jail; does she honestly think he'll put everything into keeping Max and Steph together? Janae doesn't answer.
Scarlet Bar
Katya ignores a call from Ned. Elle comes in, talking to someone called 'Forrest' on her mobile about bungee jumping. Boyd overhears Elle telling Forrest she'll see her next week. Kat makes a quip about Forrest Gump and Elle tells her that Forrest is her friend's second name - Glenn is her first name (what were her parents thinking?) Elle grew up next door to her and she's coming to stay next week. Elle thinks everyone will love Glenn and she'll break more than one heart when she's here. Boyd blinks, taking it all in.
Number 30
Carmella asks Rosie where the money is. Oliver appears a second later, asking Carmy if she found the money. Rosie is not happy that Carmella told an outsider. Carmella needed someone to talk to and, anyway, Rosie had made it clear she wanted nothing to do with it. Oliver tries to calm them down.
Rosie tells Carmella that she gave the money to the police Blue Ribbon Foundation - it's over. Carmella doesn't have to get involved in something dodgy just because Rocco asks. Carmy asks Rosie if she ever thinks she's wrong. She can't make decisions for Carmella; Rocco is her dad and she'll help him, whether Rosie likes it or not!
Scarlet Bar
Oliver walks in.
FRAZER: Good evening, Mr Barnes.
OLIVER: Oliver's fine.
FRAZER: I'm sorry, Mr Oliver, sir.
Oliver tells him to leave it - he just left World War 3. Fraze asks what they were fighting about this time and Oliver says it was to do with Rocco's money.
OLIVER: They're doing my head in!
FRAZER: Tell me about it....no, really, tell me about it?
In the office Boyd tells Elle she obviously wanted him to know Glenn was coming to Erinsborough but Elle had no clue she was the girl he had a fling with. Elle can't wait to get all the details from her. Boyd wants her to stop Glenn from coming - she's obviously coming to see him. Elle says she's no bunny boiler. Boyd thinks she should help him this once, especially after all that's gone on between their families. Elle will see what she can do.
Scarlet Bar
After ads Frazer is taking it all in. He's surprised Oliver is getting involved but Oli only wants to see Carmy happy. Frazer can see Carmella trusts him and trails off, looking thoughtful.
Number 28
Rosie goes through Katya's testimony with her. Toadie appears and asks Rosie to get him some notes for him (she informs him they're in his briefcase). Rosie has straightened out Katya's testimony for her as Toadie got her all muddled earlier on. Toadie shows Rosie out, hoping to see her after the trial until Rosie informs him she'll be at the trial (since she did most of the background work).
Toad asks Katya what her plans are for after the trial. She tells him of a job with the Adelaide Crows that Zeke told her about. He asks her what's stopping her from applying (Ned - or 'Gigantor', as Toadie puts it). He tells her that she can't let love hold her back. Relationships come and go but you're stuck with you forever.
Toadie asks for a small favour at the trial tomorrow. Katya gets the feeling it's not completely above board.
Number 30
Rosie can't find her chocolate stash (Frazer thinks Pepper must have eaten it) but at least she can buy more with her $200 000. Rosie can't believe Carmy told Oliver (who then told Frazer). Frazer would've liked to hear it from her but Rosie says they don't have to tell each other everything - this was private family stuff. Frazer agrees but they're a couple and she can trust him. But he isn't sure she does trust him. Rosie reminds him this couple stuff is all new to her - she can't just hand over the controls like that!
Frazer says he only wants her to lean on him, to let him in occasionally. Rosie says she does - she's closer to him than anybody. She just wants him to let her fight her own battles; it's the only way she knows and she wants him to respect that. Frazer doesn't look that happy.
Scarlet Bar
Carmella is still annoyed with Rosie. Oliver thinks she doesn't need Rosie or her dad. Carmy thinks she'll get the money somehow. Oliver offers to give her the money, just as soon as he gets the company stuff sorted - what else is it good for if he can't help out a friend? Carmella smiles.
In the office Elle tells Boyd that Glenn had no idea that Boyd lived in the same street and has no intentions of breaking up his marriage. When she told her the truth she'd wanted to call off the trip altogether (but didn't). It seems to Elle that while some people can deal with these things maturely Boyd has a problem.
Janae appears and Elle tells her she and Boyd were just sorting out a misunderstanding about the rent. Boyd tries to smile.
Number 32
The next morning. Steph tells Max that Boyd and Janae are getting Charlie ready. She sorts out Max's tie as he tells her she can head home as soon as she's finished giving evidence. Steph tells him not to be silly. Max explains that they're going to drag up a lot of stuff - including his friendship with Katya. Steph tells him they really know what happened and that's all that matters. She's more worried about him reliving the accident. He's been so good again - it's like she's got her old Max back!
MAX: I can do this, Steph.
Boyd and Janae bring Charlie in and hand him to Max. They make a nice family grouping just in time for Toad to march in and flinch when he sees them together. He asks if they're ready to go. Everyone looks uncomfortable.
Court
Max sits, staring ahead as he flashbacks to telling Katya about Robert's escape and urging her to get out the car. He remembers her running towards him and then him hitting Cam. He closes his eyes.
Katya is on the stand, admitting to Toadie that she loved Max but he only saw her as a friend. She answers that yes, he was protective and she always felt safe with him. Toadie asks why that was. Katya agrees with Toad when he says Max wasn't physically tough and getting into fights for her - he was a gentle person. He was the complete opposite of Rob.
Toad asks her if she thinks Max is capable of maliciously harming anyone and Katya gives a definite no.
The prosecutor, Christopher Reynolds, asks her if she was in any danger on the day Max hit Cam. Katya answers that that's what it would've looked like to Max. She got the letter from Rob that day. Reynolds reminds her that Rob hadn't escaped, so was she in any real danger when Max hit Cam with his car? Katya gives a reluctant no. Max looks worried.
Warrinor Prison
Carmella tells Rocco that she got the money - all by herself - and she can save the family business on her own too! Rocco wants to wait for Rosie - she's got the head for business. Carmy is disappointed and Rocco tells her she's good at plenty of other things. Carmella wails that she can handle it and tells him to give her the instructions - she promises she can carry them out.
Court
Elle tells the court that she and Cam were soulmates. She felt her heart was ripped out when he died and did some things she wasn't proud of. The prosecutor asks how she felt about Max.
ELLE: I hated him.
Toadie asks what her feelings are towards him now. Elle says she no longer blames him as she knows rationally that he didn't mean to hurt anyone. Max and his family have been through so much since the accident - he's suffered enough.
Number 30
Carmella asks Frazer if he'll convince Rosie to help her. Frazer says she won't tell him. Carmy is adamant Rocco isn't dodgy anymore - it's her uncle Ray who's up to no good. Frazer would help if he could. Carmella won't stop talking about how fabulous it'll be building up a business that's all above board. Frazer tells her that he's been kept out the loop on this one - he only knows about it from her and Oliver - so he's no use to her.
Carmella decides she'll just have to convince Rocco that Rosie is a liability. Anyway it's all Oliver's money and not family money. Frazer can't believe that Rosie gave the other money to charity. Oliver comes in.
FRAZER: Scrooge McDuck, eh? I'm sure two hundred Ks is just a drop in the ocean.
Oliver doesn't look happy and tells them he's just found out he has no money. He signed a whole bunch of papers when he was younger to let Will take over the business and it's impossible to undo. Carmy looks glum.
Court
Max tells the court that he didn't know himself after Cam died. He couldn't even look at his own kids because of the guilt. He lost his mind.
Toadie says that wasn't all he lost and Max agrees, saying he lost his wife and family too. It was his fault - he couldn't cope. He tells the court that it might sound as if he feels sorry for himself but he doesn't - he feels for Cam's family and can't begin to express the sorrow he feels for the pain he caused.
Toadie takes his seat.
Number 30
Frazer thinks they can't take away Oliver's inheritance but Oliver says Napier thinks it's watertight. Frazer suggests he contest it. Oliver doesn't think he could - his dad only wanted him to take it over if he was 100% committed. Maybe it wasn't meant to be.
He apologises to Carmella for not being able to help and she says it's fine - they'll get by just fine.
Court
The Prosecutor says Max told the court he'd lost his family, yet here they all are supporting him. Max tells him they gave him a second chance. Reynolds tells him that the court can see how regretful he is but they have to rely on facts.
PROSECUTOR: You killed a man. And for that a price must be paid.
The Prosecutor reminds him that he evaded justice by breaching his bail conditions and walking out on his family.
MAX: It wasn't like that.
PROSECUTOR: No?
MAX: No. You make it sound like it was just an easy decision - it wasn't. It was an agonising choice and my family went through hell because of it.
PROSECUTOR: Yet, Mr Hoyland, a mere six months later everything's back to normal for you. But Cameron's family will never be the same again.
MAX: My life will never be the same again - my marriage wi -
He sees Steph, stops himself and apologises to the court.
MAX: I didn't mean to kill Cameron. I never set out to hurt anyone. But I killed a man. I understand that. And I'm going to have to live with that for the rest of my life.
PROSECUTOR: Mr Hoyland, did you swerve your car toward Cameron Robinson? In your panicked state, with all the best of intentions I'm sure, did you deliberately swerve your car towards him?
Max looks towards Steph as everyone else in the courtroom looks at him. After a few seconds he answers.
MAX: Yes...Yes, I did.
